These terms and conditions are entered into by and between Unity 23 Fitness Ltd (hereinafter: Unity 23) and You (hereinafter: “the Member or Trialist”). Membership (hereinafter: includes 23-Day Trial)
These terms and conditions are entered into by and between Unity 23 Fitness Ltd (hereinafter: Unity 23) and You (hereinafter: “the Trialist”).
Services:
The membership entitles the usage of Unity 23’s facilities and the equipment & services available therein. The 23-Day Challenge gives access to all Unity 23 sites, except if specified otherwise.
Membership:
The 23-Day Challenge is personal, and cannot be shared.
Age Limit:
The Trialist confirms that he/she is 18 years old or older. For persons 16 or 17 years old, exceptions are granted based on a written parental consent. Persons under 16 years of age must be supervised at all times.
Health:
The Trialist confirms that he/she does not suffer from health problems that would hinder exercise or prevent him/her from engaging in exercise, or that would be detrimental or adverse to the Trialist’s health, safety or physical condition if he/she did exercise. In case of any doubt, the Trialist shall seek advice by a medical doctor who should confirm the ability to exercise.
Unity 23 shall have no obligation to perform a fitness assessment or similar testing to determine the Trialist physical condition. If an assessment is done at Unity 23, it is for the sole purpose of compiling comparative data in order to track the Trialist progress in a programme and not for diagnostic purposes.
Liability:
Each Trialist of Unity 23 shall be liable for any property damage and/or personal injury caused by the Trialist on the Unity 23 premises. It shall be the obligation of the Trialist to pay for any costs involved upon presentation of a statement thereof.
Waiver of Liability:
Any and all use of the Unity 23 facilities shall be at Trialist’s own risk at all times. The Trialist shall not utilise any equipment unless he/she knows the appropriate usage. Unity 23 shall not be liable for any injuries, physical impact or damages to the Trialist, or the property of the Trialist, or be subject to any claim arising out of the use of the premises and/or of the equipment made available to the users.
Personal Belongings:
Please note that we do not have lockers on-site. Open cubbies are available to store personal belongings while using the facility. However, these are not lockable, so we recommend keeping valuables with you at all times. Unity 23 is not responsible for any lost or missing items.
Lost Property or Theft:
Unity 23 does not take responsibility for loss or theft of any personal belongings. Any items left on The Unity 23 premises will be kept for a period of four weeks before being disposed of.
Code of Conduct:
The Trialist shall respect the behavioural and operating principles of Unity 23, as laid out in our code of conduct. In this case, the Trialist will not be refunded or otherwise reimbursed for the Challenge fee.
Suspension/Termination of 23-Day Challenge:
If the Trialist behaves in a way that breaches the code of conduct, the 23-Day Challenge can be suspended or terminated at management’s sole discretion.
Access & Security:
Unity 23 is open Monday to Thursday from 6:30am to 8:30pm, Friday from 6:30am to 7:30pm, and Saturday from 9:00am to 12:00pm. Please note that hours may vary on bank holidays or in exceptional circumstances.
Class times are listed in Unity 23’s booking system and may be subject to change without prior notice. Instructors and scheduled sessions may also change at short notice.
Payment:
The Trialist is responsible for the payment of the 23-Day Trialist Fee. This is true even if the amount is debited directly by Unity 23. Agreed price only applies if the Trialist pays according to the agreed conditions.
The 23-Day Trial is a standalone product with a one-off fee. There is no ongoing commitment to the Unity 23 once the Trial is completed. If the Trialist decides to sign up for an ongoing membership, the Membership Ts and Cs will become active.
When the 23-Day Trial is complete, and if the Trialist signs up for full membership, the below terms and conditions will come into effect.

Unity 23 is open Monday to Friday 6am until 9pm, and Saturday from 7am – 2pm, with the exception of bank holidays and exceptional circumstances, when times may vary. Classes are available according to times stated in Unity 23’s booking system. Classes and instructors are subject to change with no prior notice.
Payment:
The Member is responsible for the payment of the membership. This is true even if the amount is debited directly by Unity 23. Agreed price only applies if the Member pays according to the agreed conditions.
Monthly rolling agreement:
The first month’s payment or pro-rata amount and any sign-up fee are paid at the point of this agreement. The following monthly payments should be paid before each new month. The Member is responsible for all payments, also in the case of automatic debits by Unity 23 and the Member has given approval for an automatic debit from his/her account or card and any wish to cancel must be communicated in writing with a minimum of 60 days notice, to include all payments scheduled to be made during this period.
If the payment is late the member will receive a reminder email from Unity 23 and access may be suspended. The membership continues to run even if the access is suspended. If after 30 days the amount is still not paid, the Member is in violation of the contract and the total outstanding amount of the contract will be due. Unity 23 may transfer the case to a debt collector, which will add additional fees.
Satisfaction Guarantee:
During 7 days from the start of the membership, the Member can cancel his membership free of charge, and will be reimbursed in full.
Renewal & Cancellation:
There is no set contract period, the membership is automatically renewed on a monthly rolling basis unless.
The membership renewal is triggered by the payment of a subsequent month. If the Member has opted for a direct debit from an account or card, the cancellation must be communicated in writing with at least 30 days notice, with any payments due during this period to be made, by sending an email to hello@unity23.fitness
Exceptional Cancellation:
An early cancellation is exceptionally granted if the Member moves more than ten miles away from any Unity 23 facilities, on presentation of an official document to prove change of address. It is also possible to cancel the membership due to medical reasons, upon presentation of a medical certificate.
Price Changes:
Prices will increase in line with inflation, on an annual basis, on January 1st.
Frozen Membership:
It is not possible to freeze memberships, except due to exceptional circumstances where it is medically impossible to use Unity 23’s services. In this case, a signed medical certificate will be required as proof.
